Nonprofit Day at the Capitol

This year a sector-wide Day on the Hill matters!

The end of 2007 brought a Minnesota Supreme Court decision that could have lasting implications for nonprofit charitable tax exemptions. An agreement was reached during the 2008 legislative session between legislators, the Department of Revenue and the Council of Nonprofits to preserve the existing practices on these assessments until a comprehensive legislative “fix” could be devised. On the last night of the session, the Omnibus Tax Bill passed with “moratorium language” and was signed by the Governor on May 29, 2008. This was good news for Minnesota's nonprofits!

But the moratorium will expire on the enactment of legislation establishing criteria for the property taxation of purely public charities or adjournment of the 2009 regular legislative session, whichever comes first. The need to pass clear and consistent standards for determining nonprofit tax status is key!
